Should you pay child support if you are not the biological father
At the time of divorce, you will have to make the child support payments. In most of the instances, mothers are provided with custody of the child. The non-custodial father will be asked to make the child support fee. The child custody agreements would determine the specific amount that has to be paid per month. But if you are not the biological father of the child, you must be wondering whether you should keep on paying the child support fee or not.
There is no straightforward answer to this question. That’s because the laws related to this would change from one state to another. In fact, all the laws that are related to child support vary from one state to another. In some of the states, non-biological fathers who end up being on the non-custodial side will have to make the child support fee. This is determined if the father has been there as a part of child’s life from the birth. Then the father will be asked to make the child support payments, even if he is not the biological father.
You can also find some states, where fathers are not required to pay the child support fee, if they can prove that they are not the biological fathers. This should be done with a DNA test. Court will consider DNA report as a proper evidence to accept to the fact that a person is not the biological father. Therefore, he will not be asked to make the child support payments. You can get more information about this by getting in touch with your lawyer.
